Science and the art of thought dominate all professions in the world. In any profession, whether formal or informal, technical or non-technical, the use of reasoning is a common element in their daily affairs. Although the application of thought in reality is often more practical than the theoretical application of this research. In the world of law, the use of reasoning is a predominant necessity because the law itself is a product of argumentation. This type of reasoning is called “legal reasoning.” The fundamental objective of this work is to examine reasoning as it is used in the legal world and how this type of reasoning is often used in court proceedings. This article is subject to a critical assessment of the problems in the practice of the doctrine of legally binding precedents in Nigerian Sharia courts and the related implications of their practice in these courts. Particular attention is also being paid to factors that may influence the application of doctrine in the country`s Shari`a courts in the coming period. In essence, the document concludes that stare decisis is not part of the Islamic judicial system, either substantively or procedurally; Its application of Sharia law in Nigerian courts and, indeed, in any other Sharia court elsewhere in the world cannot therefore be justified. This is an aberration.
